DANIEL MYLREA from JOHN CHRISTIAN

Purchase 1687 (Jurby)

Know all men by these presents that we John Christian of Ballacurry in the parish of Jurby with Amy my wife having heretofore engaged a certain Close or parcel of Curragh land part of our tenement commonly known and called by the name of Close Cain or Close ne Shuen by way of mortgage to John Woods of Trinity Ayre for a certain term of years; and in the bill of mortgage made for the same it was covenanted and conditioned by us that in case at any time we did either sett or sell the said Close to any person that the said John Woods was to have the first proffer thereof before and as cheap of any other

And now for as much as the said John Woods has assigned over his said bargain unto our loving friend Daniel Mylrea who hath already paid and satisfied unto the said John Woods the sum of three pounds ten shillings for the releasement of the said mortgage; and also hath already paid and satisfied unto Pat Brew of Jurby the said sum of six pounds for the releasement of a Bill that he had upon the said Close

In consideration of which payments and also for the sum of fifty shillings sterling more, thirty shillings of which is already paid and satisfied unto us and the other twenty to be paid upon the obtaining of the worshipful officers confirmation of these presents being for the supplying of our very good need and generosity

Have given, granted, bargained, passed over and sold and do by these presents (and with the full consent and assent of our eldest son Robert Christian) give, grant, bargain, pass over and forever absolutely sell unto the said Daniel Mylrea of the parish of Ballaugh, his heirs, executors, administrators and assigns all the forementioned Close Cain or Close ne Shuen with its proportion of the lough being of the annual or yearly rent of twelve pence

To have and to hold the said Close with all its appurtenances as ways, water courses, easements, liberties, profits, commodities and advantages to the same in any wise appertaining unto him the said Daniel Mylrea, his heirs, administrators, executors and assigns without the stop lett, hindrance, disturbance, or vexation of us the said John Christian and Amy my wife or Robert Christian our eldest son or any other person or persons claiming from, by, or under us or any other act procured from us or either of us to the contrary hereof in anywise; he the said Daniel Mylrea, his heirs, executors, administrators and assigns yielding and paying the annual rent aforesaid to the honourable Lord of this Isle at the times and seasons accustomed

And we the said John and Amy do hereby oblige ourselves to procure the worshipful officer's confirmation to this bill and he the said Daniel Mylrea his name to be entered as right tenant to the same Close at May courts next, and do all other things for his further assurance as shall be requisite according to the laws of this Isle

And for the true and faithful performance of the same we have bound ourselves, our heirs, executors, administrators and assigns in the penalty of twenty pounds sterling to be levied in nature of forfeitures

And to witness the same we have hereunto sett our names and marks this 23rd day of May in the year 1687 . John Christian, Amy Christian als Clark her mark

The within named John Christian and Emmy (sic) his wife with their son Robert came this day and acknowledged all the within ….. to be their voluntary act and deed. And this before me, Edward Christian

At a Sheading court holden in Peeltown the 1st June 1687

Upon the acknowledgement made of this Bill before Mr Deemster Christian as is above certified, the court hath granted their allowance and confirmation to the same according to the statute made in that behalf. Robert Heywood, Edward Christian, Fletcher Calcott, Peter Heywood

NOTES

  2. Daniel's son, also named Daniel, sold Close ne Shuen to Thomas Callister for £60 in 1733. Daniel snr paid £13/-/- for it in this current Bill of Sale
  3. This is a perplexing contract inasmuch as Daniel's father William Mcylrea, purchased Close ne Shuen from William Kermode(recorded in LV 1691). He left it to his wife Ann, to be passed to his youngest son Robert when Ann died (which she did a year after William). The wills of both William (1692) and Ann (1693) confirm the Mylrea possession of the intack purchased from Kermode
  4. There is a difference in annual rent for the Kermode intack (12d) compared to the current contract (8d) so presumably two parcels of land sit within a larger area in Jurby named Close ne Shuen
  5. Daniel Mylrea sold a 12d intack to William Clark in 1698, and this is more likely to be the land destined for Robert, but it means then that Robert has died since his mother's death in 1693
  6. CLOSE NE SHUNE = Close of the Rushes

7s 10d Capt Wn Mcylrea 12d to Wm Clark 12d The above named Wm Clark is entered for the above 12d rent by vertue of a bill of sayle from Mr Deemster Mclrea son to [lost] allowed of and confirmed by the [officers?] - NOTE - this entry would tend to suggest that the intack land was never transferred to Ann after William died, nor to Robert after his mother died, and that Daniel sold it after Robert died
